Hull and Kwan highlight the legal and health concerns associated with per- and poly-fluoroalkyl substances (PFAS) in port operations, as international treaties and regulations increase scrutiny over these “forever chemicals.”
PFAS are widely used across various industries, appearing in products like firefighting foam, nonstick coatings, and food packaging. However, they degrade slowly, accumulating in the environment and posing potential health risks such as cancer, hormonal disruption, and developmental issues. Recognizing the challenges of managing PFAS, Hull and Kwan emphasize that port operators must understand how these regulations could affect their liability and responsibilities.
To address these risks, Hull and Kwan explain key frameworks governing PFAS, which set rules on the handling, disposal, and notification of PFAS in the United States. Given the evolving legal landscape, Kwan and Hull recommend that ports stay informed on PFAS regulations and proactively address potential liabilities in port operations.
