Athena Troy
Athena Troy is of counsel in BBK’s Municipal Law practice group where she specializes in advising private companies and public entities regarding complex coverage disputes with both traditional insurance carriers and Joint Powers Authority Risk pools. Athena has over fifteen years of experience assisting clients with conducting insurance archaeology efforts, including locating evidence of legacy insurance policies, pursuing and defending claims for defense and indemnity coverage in environmental and other liability coverage related matters. She also handles claims for coverage as an additional insured, negotiating settlements with insurance carriers, providing coverage opinions and advice, providing transactional and risk management advice, and preparing and responding to reservation of rights letters.
While in law school, Athena served as a distinguished member of the San Diego Law Review and was a Judicial Extern for the former Magistrate Judge Leo S. Papas of the U.S. District Court for the Southern District of California.
Athena lives in Denver, Colorado with her husband and two daughters. She is a mediator for the Colorado Bar Association Court Mediation Services Program. Athena also volunteers as a Board of Director at her daughter’s school, the Rocky Mountain Deaf School, a public charter school in Jefferson County, Colorado. Athena is a passionate advocate for the right of deaf and hard of hearing children to learn American Sign Language.

- Served as coverage counsel for a municipality which was involved in a CERCLA cost-recovery lawsuit and an investigative order issued by the California Department of Toxic Substances Control (DTSC) regarding a site with soil contamination. Athena’s efforts result in her client obtaining defense coverage for both the DTSC claim and the lawsuit. Athena successfully negotiated a favorable settlement agreement among six different legacy insurance companies in order to fully fund the multi-million dollar settlement.
- Defended a California special district in a CERCLA cost-recovery lawsuit involving a polluted lake which was the subject of an investigative order issued by the California Regional Water Quality Control Board. Athena handled all aspects of obtaining defense and indemnity coverage for the lawsuit from investigating the existence of historical liability coverage, tendering the claim to the legacy insurance carriers, and obtaining a favorable settlement which was fully funded by three legacy insurance carriers and a JPA risk pool.
- Represented a JPA risk pool whose member agency was sued in several lawsuits alleging crop damages caused by chemicals which were applied by a helicopter service. Athena successfully navigated and resolved several highly complex coverage disputes among her client, its member agency, its member agency’s additional-insurer, and her clients’ reinsurer and excess insurers. Athena’s efforts ultimately paved the way for the favorable resolution of all of the underlying lawsuits.
