Best Best & Krieger LLP (BBK) attorney Ivy Chase has co-authored an article in the Fall 2026 issue of the State Bar of Montana’s Montana Lawyer. The article examines how trademark disputes involving businesses operating in Indian Country can be complicated by federal trademark law, tribal sovereignty, jurisdiction and state law.

In their article, Chase and David Baker, Intellectual Property and Commercial Litigation attorney with the Law Office of David Christopher Baker, explore the challenges that can arise when trademark disputes involve businesses operating on tribal lands. They explain that trademark registration alone does not determine how or where a dispute will be resolved. The article emphasizes the importance of understanding the interaction between these legal systems before a dispute arises, especially as tribal enterprises expand into broader commercial markets. As the authors explain, “The registration is the starting line, not the finish.”
