Best Best & Krieger LLP (BBK) Municipal attorney Marco Martinez has authored an article for the Daily Journal on the ever-changing legal framework surrounding sign regulation. In the article, Martinez offers insight into how cities can regulate billboards while navigating First Amendment considerations.

Martinez explains that cities can still regulate signs and billboards but must do so carefully to avoid violating free speech protections under the First Amendment. He notes that recent court decisions have clarified that regulations based on a sign’s location, size or structure are generally allowed. Rules based on the message displayed face much greater legal scrutiny. Martinez advises cities use clear, objective standards, avoiding content-based categories and regularly reviewing sign codes to ensure they remain legally compliant.
