Redaction Refresh* is a webinar series designed to help public agencies better understand the proper use of exemptions written in to the Public Records Act (“PRA”). From the very beginning of the PRA, the Legislature recognized that public right of access must sometimes yield to necessary privacy interests. In those instances, public agencies must narrowly apply exemptions, either to entire documents or with careful precision to specific information within a document. Redaction Refresh focuses on best practices that can help agencies properly assess when an exemption may apply and, if appropriate, how to apply the exemption so as to avoid infringing on the public’s right of access.

Jan. 10* PRA Recodification - Exemptions
Effective January 1, 2023, the CPRA was recodified and reorganized to make the Act easier to read and understand. Best Best & Krieger will present information on the newly-recodified exemptions previously found in the subdivisions of Government Code section 6254.
Jan. 24* Investigatory Privilege
Best Best & Krieger will cover what information is subject to the Investigatory Privilege pursuant to California Government Code section 7923.600 et seq
Feb. 14* Deliberative Process Privilege
Best Best & Krieger will review the balancing test contemplated by California Government Code section 7922.000, known as the Deliberative Process Privilege.
Feb. 28* Procurement Records
Best Best & Krieger will examine the disclosure of records pursuant to California Government Code section 7920.530, including documents related to requests for proposals and the timing of their release under the Act.
Mar. 14* PII
Best Best & Krieger will discuss compliance with the California Public Records Act when considerations of Personally Identifiable Information (“PII”) are at issue.
Mar. 28* Utility Customer Data
California Government Code section 7927.410 et. seq. states public utilities generally shall not disclose a customer’s electrical consumption data. Best Best & Krieger will review the exceptions, including upon court order or at the request of a law enforcement agency relative to an ongoing investigation.
Apr. 11* Taxpayer Data
Records related to personnel records, medical files, pending lawsuits, taxpayer data, privileged information, library borrowing history, employee relations maters and homeland security initiatives are exempt from the disclosure rules contained in the California Public Records Act. Best Best & Krieger will analyze the taxpayer data exemption under California Government Code section 7922.000 and 7922.505.
Apr. 25* Critical Infrastructure Info
Best Best & Krieger will discuss compliance with the California Public Records Act when critical infrastructure information is at issue, in compliance with California Government Code sections 7927.500 and 7927.705.
May 9* Mental Health Records
Best Best & Krieger will consider compliance with the California Public Records Act when mental health records are at issue, in compliance with the California Public Records Act and Welfare & Institutions Code sections 5150, 5328.
May 23* Financial Data
When a public agency requires that applicants for licenses, certificates or permits submit personal financial data, that information is exempt from disclosure pursuant to Government Code section 7925.005. Best Best & Krieger will outline this exemption and its construction.
Jun. 13* Reporting Party Data
The California Public Records Act requires public agencies to disclose code enforcement records, but agencies may rely on the exemption pursuant to California Government Code section 7922.000 to protect reporting party data. Best Best & Krieger will detail this exemption under the CPRA.
Jul. 6* Pending Litigation
Records related to personnel records, medical files, pending lawsuits, taxpayer data, privileged information, library borrowing history, employee relations maters and homeland security initiatives are exempt from the disclosure rules contained in the California Public Records Act. Best Best & Krieger will analyze the exemptions to pending litigation under California Government Code sections 7927.500 and 7927.200.
Jul. 11* Domestic Violence Records
A victim of sexual assault or domestic violence or their guardian may use the authority of California Government Code section 7923.615 to withhold disclosure of his or her name. Best Best & Krieger will discuss this exemption
Aug. 1* Labor Negotiations
Best Best & Krieger will present information on how the California Public Records Act dovetails with California Government Code section 54957.6 with respect to Labor Negotiations in Closed Session.   
Aug. 8* Attorney Client Privilege
California Government Code section 7927.705 exempts from disclosure records that are exempt pursuant to the provisions of the Evidence Code relating to privilege. Best Best & Krieger will detail this exemption and its applicability to PRA Requests.
Aug. 22* Planning Department Records
Best Best & Krieger will discuss compliance with the California Public Records Act pursuant to California Government Code section 7921.000 when considerations of Planning Department Records are at issue.
Sept. 12* Personnel Records
California Government Code section 7927.700 exempts from disclosure personnel files that would constitute an unwarranted invasion of personal privacy. Best Best & Krieger will describe this exemption and how it interacts with California’s constitutional right to privacy (Cal. Const., art I § I).
Oct. 10* Trade Secrets
Best Best & Krieger will examine trade secrets, and how a trade secret is not a public record under California Government Code Section 7924.510 or 7924.700.
Oct. 24* Official Information Privilege
Pursuant to California Government Code section 7922.000 and Evidence Code section 1040, a public agency may refuse to disclose information acquired in confidence by a public employee in the course of his or her duty and not open, or officially disclosed to the public prior to the time the claim of privilege is made. Best Best & Krieger will examine the interplay between these exemptions.
Nov. 1* Rates
Best Best & Krieger will present on compliance with the California Public Records Act when rates are at issue.
Nov. 14* Unique Identifiers
Certain unique identifiers are exempt from disclosure, such as unique identifiers used for purposes of voter registration, unique health identifiers under HIPAA, and other circumstances. Best Best & Krieger will discuss these exemptions in the context of the California Public Records Act.
Nov. 28* Elections Data
Pursuant to California Government Code section 7924.000, voter registration information is confidential and cannot be disclosed except as provided in section 2194 of the Elections Code. Best Best & Krieger will review this exemption in the context of the California Public Records Act.  
Dec. 12* Library Patron Data
In accordance with California Government Code section 7927.105, all patron use records of any library that is supported in whole or in part by public funds are confidential and may not be disclosed except to persons acting within the scope of their duties within library administration, upon written authorization from the person whose records are sought, or by court order. Best Best & Krieger will discuss this exemption in the context of the California Public Records Act.
