Best Best & Krieger LLP (BBK) Of Counsel, Cheryl Leanza, has been quoted in Communications Daily’s article discussing the 8th Circuit’s decision to vacate the Federal Communications Commission’s (FCC) top-four ownership limit.

Leanza, who has previously participated in legal challenges over the FCC's quadrennial reviews, argues that restricting the FCC’s ability to revise its rules only during those reviews defies legal precedent and leads to “incredibly irrational results.” Having submitted an amicus brief supporting the FCC, Leanza believes the agency should have the flexibility to adjust regulations in the public interest at any time. She also noted that a recent 8th Circuit ruling contradicts a 3rd Circuit interpretation of Section 202(h), creating a legal split. “I think the Supreme Court would be very sensitive to the idea that you could hamstring the agency from being able to make modifications to its own rules,” she said.
