Partner Joseph Van Eaton Discusses Clash Between Cities and Wireless Industry Over 5G During COVID-19

In an interview with Law360, Best Best & Krieger LLP Partner Joseph Van Eaton discussed how the wireless industry is trying to use the COVID-19 pandemic to argue for broader deregulation from the federal government to circumvent local control over the public the right of way.
 
The national publication reports that the wireless industry is claiming that 5G infrastructure rollout is being delayed under social distancing and remote work orders put in place by local and state governments in response to the coronavirus outbreak. 
 
"Everyone on the municipal side is going, 'What in the world are they talking about?'" Joe told Law360. "As usual, instead of working with [localities, industry is] going to the FCC with a problem that could be solved, if it exists, informally…"
 
"Hopefully at some point, they will realize that local governments are trying to solve problems, but it doesn't help to make them come to Washington to work them out," he added.
