Kavanaugh and the Clean Water Act

With the Clean Water Act likely to come before the U.S. Supreme Court, Bloomberg Environment talked to Best Best & Krieger LLP Partner Andre Monette for an article on how Brett Kavanaugh, the President’s nominee to the Court, might address the issue.
Andre represented water agency associations in an amicus brief in County of Maui v. Hawaii Wildlife Fund, et al in the Ninth Circuit U.S. Court of Appeals — one of the pending cases that may make its way to the Supreme Court. Andre told the publication that Kavanaugh, who once clerked for retiring Justice Anthony Kennedy, has a reputation for not allowing federal agencies a lot of leeway in environmental cases.
“Kavanaugh would probably look back and say discharges through groundwater are not covered by [water pollution laws],” Andre told Bloomberg Environment. “I’m not certain that Kennedy would do the same.”
