This Best Best & Krieger LLP webinar covered the California Supreme Court’s recent City of San Jose decision, which held that when a public agency employee uses a personal account to communicate about the conduct of public business, the writings may be subject to disclosure under the California Public Records Act. 

BB&K attorneys Gary Schons and HongDao Nguyen discussed what the Court did and did not decide, how and why the Court reached its conclusions, and the decision’s legal ramifications going forward. The session explored the policy and practical implications of the decision for public entities and suggested measures for public officials, executives and administrators, and employees to adopt to protect privacy while ensuring transparency and compliance with the Public Records Act.
