Understanding and Responding to the FCC Cable In-Kind and Mixed Use Order

A new FCC Order updating cable franchising rules could cost local governments in every state hundreds of millions of dollars. The Order arms cable operators with the right to require existing franchise terms be modified to offset from franchise fees many in-kind benefits, including free cable services, I-Nets and, potentially, Public, Educational and Governmental Access Channel capacity. Unlike prior FCC cable orders, this Order applies in all states, including those where franchises are granted at the state level. This includes California, Texas, Michigan and 20 others.
